These Rental Terms and Conditions (the "Terms and Conditions") set forth the policies, rules, and regulations that apply to your rental of textbooks and/or course related materials (the "Rented Materials") from Barnes & Noble.
These Terms and Conditions set forth your rights and obligations and should be read carefully. In these Terms and Conditions, "you" or "your" means any person or entity renting Rented Materials from us using this online rental service (the "Service"). Unless otherwise stated, "Barnes & Noble", the "Company,", "we", "our", or "us" will refer collectively to Barnes & Noble Booksellers, Inc. By using the Service, you agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, you may not use the Service.
The Company may modify these Terms and Conditions from time to time and such modification shall be effective upon posting by the Company on the website from which you accessed the Service (the "Website"). You agree to be bound to any changes to these Terms and Conditions when you use the Website or the Service after any such modification is posted as well as any other Terms and Conditions or Privacy Policy posted on such Website. It is therefore important that you review these Terms and Conditions regularly to ensure you are aware of any changes. By agreeing to these Terms and Conditions please note that you are also agreeing to be bound to the general terms of use of the Website.
Rented materials returns cannot be accepted at a Barnes & Noble store. Please utilize the prepaid shipping label to return your rented materials. Prepaid Shipping labels can be printed by logging into your bn.com account and going to the "manage my rentals section".
You can also return the rented materials for any or no reason for a full refund minus $5 return fee per item during the early return window of 21 days from the date of the order. You will be charged replacement fees, for books that can no longer be rented. If the rented materials are lost or stolen, a replacement fee will apply.
During your rental period, all rented materials remain the full property of Barnes & Noble. Your acceptance of the rented materials and paying rental prices entitles you to use the property of Barnes & Noble for a limited amount of time and binds you to these Terms and Conditions. At the end of the rental period, you exit out of the Terms and Conditions and lose all rights to the rented materials.
Rented materials must be returned using the prepaid shipping label at least 5 days prior to the rental return date designated by us at the time of rental (the "Rental Return Date") to avoid any late fees or non-returned fees. Prepaid Shipping labels can be printed by logging into your bn.com account and going to the "manage my rentals section".
All rented materials must be returned in salable condition. Salable condition will be determined by us in our sole discretion, but generally means book spine intact, no excessive damage to cover or contents, all original pages intact, all original components present, and no excessive highlighting, writing or other markings. Normal use highlighting and writing is permitted. Any writing or highlighting that Barnes & Noble deems excessive or that hinders the readability of the Rented Materials will be your responsibility and you will be charged for a replacement.
Please follow all of our guidelines to ensure no fees will be charged to your account. If the Rented Materials are not received by the Rental Return Date, your rental will be extended by 15 days and you will be charged for such extension. If your Rented Materials have not been returned by the end of this 15 day extension, you will be charged a Non-Return Fee, which is used to cover the cost of replacing the Rented Materials. This fee is equal to 100% of the list price of the Rented Materials minus your rental costs and the cost of the late fee. Once you are charged the Non-Return Fee, you opt out of the Terms of Use and the Rented Materials become your property.
In the event that the credit card on file for you is no longer valid or in the event the purchasing limit on such credit card has been exceeded at the time the Non-Return Fees are to be charged, we will bill you for, and you agree to promptly pay in full, the Non-Return Fee. We reserve the right to charge the payment method that was used during initial rental or the latest payment information you have in your online account for any Extension or Non-Return fee, or the payment method we currently have on file for you that was updated by the applicable payment service provider, and to which you authorize us to continue to charge any Extension or Non-Return fee. If the payment attempt fails due to any reason we reserve the right to make multiple attempts to successfully charge your payment method for the amount due.
If you have not returned the Rented Materials by the Rental Return Date and we are unable to charge your credit/debit card, it is your responsibility to pay the Non-Return Fee immediately. You will be notified via email if your credit/debit card was declined and have 15 days to pay this fee before your account is turned over to a third-party collection agency.
You agree we, or a company acting on our behalf, may contact you by telephone, short messaging service (text messaging), or e-mails at any telephone number or e-mail address associated with your account, including wireless telephone numbers (i.e., cell phone numbers) which could result in charges to you, in order to service your account or collect any amounts owed to us, excluding contacts for telemarketing purposes as prescribed by law.
For information on how you purchase your Rented Materials, please sign-in to your account and select "Rental Management-Manage Textbook Rentals." The purchase price for the Rented Materials is the list price minus any rental fees you have already paid. You can purchase your Rented Materials at any time during your rental period, up until your Rental Return Date. If you choose to purchase your Rented Materials at the end of your rental period, your purchase will be a final sale. You will not receive a refund if you attempt to return Rented Materials that have been previously purchased by you.
Barnes & Noble is not responsible for reminding you of your Rental Return Date. Any and all notifications are a courtesy. You are responsible for complying with the Rental Return Dates.

Rented Materials cannot be shipped outside the continental United States.
